TERMS & CONDITIONS

These Terms & Conditions govern the use of the “Sinar Harian NewsStore” platform (“Platform”) and the Services (as defined hereinafter) provided by Sinar Karangkraf Sdn Bhd (Company No.: 200401012066 (650569-D)) (“Company”).

This Platform is operated by the Company to facilitate your subscription to the Company’s products (“Services”) which include but are not limited to: Sinar Harian newspaper (Print edition), Sinar Harian ePaper, Premium, SinarPlus, and Digital Access to Sinar Harian (collectively, “Products”).

By using this Platform and subscribing to the provided Services, you are deemed to have read, understood, and fully agreed to be bound by these Terms & Conditions. Please read these Terms & Conditions carefully before subscribing to the Services and using the Platform as it contains legally binding terms and obligations.

PAYMENT

Subscription fees must be paid in advance. By subscribing to the Services, you authorize the Company to charge you for the subscription fees. In addition to the subscription fees for each Product, you are also responsible for paying any taxes and/or levies that may be imposed by agencies/authorities. For the avoidance of doubt, the subscription fees herein include the service tax provided under the Service Tax Act 2018. Without prejudice to any of our rights, you agree that we have the right to suspend any aspect of the subscription you may be using if you fail to pay any outstanding subscription fees or if you violate these Terms & Conditions. A certificate signed by a Company officer is conclusive evidence of the amount of subscription fees owed under the subscription or related to the Platform (unless error is proven). If we incur expenses to recover the amounts owed to us, you further agree that we may recover legal fees on a solicitor and client scale, disbursements, and any loss related thereto.

ACCESS TO PASSWORDS AND ACCOUNTS

You are responsible for ensuring that your account information is current and accurate.

As a holder of a Sinar Harian NewsStore account, you will have access and control over your account. Your account contains some sensitive information such as subscription information, payment methods, and payment information. To ensure the security and privacy of your information, please do not provide your password or payment information to anyone.

You are advised to be cautious of anyone requesting your credit card information or other information in your account. You are advised to access your account information by going directly to http://www.sinarharian.com.my/product-page and not through hyperlinks in emails or certain electronic communications.

PERSONAL DATA & PRIVACY NOTICE

By browsing the Platform, registering for a Sinar Harian NewsStore account, you hereby consent to the Company and/or subsidiary and/or affiliated companies (“Karangkraf Group”) to collect and process your Personal Data (as provided for in Section 4 of the Personal Data Protection Act 2010).

DISCLAIMER AND LIMITATION OF LIABILITY

The Services are provided to you “as is” and without warranties or conditions.

You agree that your use of the Platform and subscription to the Services is at your own risk. To the extent permitted by law, the Company and its officers, directors, employees, shareholders, agents, and/or representatives disclaim all warranties, express or implied, relating to the use of the Platform and Services. You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, shareholders, and agents from any claims, including legal fees, costs, and expenses made by or on behalf of third parties in connection with or arising from your use of the Services or arising from your breach of these Terms & Conditions herein.

LAW & JURISDICTION

These Terms & Conditions are governed by the laws of Malaysia and any disputes arising therefrom are subject to the jurisdiction of the Courts in Malaysia.

SINAR HARIAN ePAPER SUBSCRIPTION

1. Subscription

A subscription to Sinar Harian ePaper is a subscription to the digital replica of the Sinar Harian newspaper (Print edition), where all sections published in the Sinar Harian newspaper (Print edition) are available in Sinar Harian ePaper.

You are not allowed to transfer your subscription to a third party.

2. Availability and Continuity

You require internet access to access Sinar Harian ePaper. Your device must be connected to the internet to allow you to browse Sinar Harian ePaper. If you are reading Sinar Harian ePaper from a mobile application, you need an internet connection to download issues of Sinar Harian ePaper and to use the article sharing functions enabled by the mobile application.

We reserve the absolute right to:

  • approve or reject your subscription request;
  • upgrade or change any features of Sinar Harian ePaper;
  • withdraw any part/section/page of Sinar Harian ePaper without prior notice;
  • change our prices and/or withdraw subscription packages at any time, without prior notice;
3. Payment and Processing
  • We are not responsible for any internet browsing charges, and all expenses incurred by you for using Sinar Harian ePaper;
  • Payment for Sinar Harian ePaper can be made via online payment only,
  • Proof of payment is not proof of receipt, and we will not be responsible if your money is lost in transit.
  • You may start accessing Sinar Harian ePaper once your Sinar Harian ePaper account has been successfully registered.
  • Upon successfully processing your subscription, we will notify you by email, which will also state the duration of your subscription (i.e., start date and expiry date) (“Subscription Notification”). 4. Renewals

You may renew your subscription after the expiry of your current subscription period.

5. Responsibility
  • Unless permitted herein, you are not permitted and shall not permit any third party to make, distribute and/or resell copies of Sinar Harian ePaper, attempt to copy, make screenshots, print screenshots, reproduce, modify, alter, transfer, change or translate the application or its content, and/or create derivative works of the application publication in any form whatsoever. If you are reading Sinar Harian ePaper from a mobile application, you are entitled to ten (10) limited screenshots (“Limited Screenshots”) for personal reference and/or note-taking purposes. Once you have used up all the Limited Screenshots, you will be automatically logged out of the mobile application for ten (10) minutes. After the ten (10) minutes have elapsed, you may log back into the mobile application to access Sinar Harian ePaper.
  • We reserve the right to block, limit, terminate, or change any aspect of Sinar Harian ePaper, including but not limited to content and subscription plans from time to time.
  • We reserve the right to immediately terminate your access to Sinar Harian ePaper if you breach any of these Terms & Conditions.
  • We have the absolute right to change the Terms & Conditions contained herein at any time without prior notice.
  • You agree that we shall not be liable at all for the failure to perform any of our obligations herein to provide a subscription to Sinar Harian ePaper if such failure is caused by circumstances beyond our control and that we shall also not be responsible for any loss suffered by you directly or indirectly, in connection with your subscription.
  • If you are using PressReader for Sinar Harian ePaper, your use of Sinar Harian ePaper is also subject to the Terms of Use and Privacy Policy of the PressReader Service. In the event of any conflict between the Terms of Use and/or Privacy Policy of the PressReader Service with the Terms & Conditions contained herein, our Terms & Conditions shall prevail. 6. Use and Disclosure of Personally Identifiable Information and Anonymous Information

By agreeing to the terms and conditions contained herein, you hereby consent to the Karangkraf Group collecting and processing your Personal Data (as defined by Section 4 of the Personal Data Protection Act 2010). You also agree to allow the Karangkraf Group to share your name and address with sellers/distributors appointed by the Karangkraf Group for the purpose of delivering the Sinar Harian newspaper (Print edition) to you.

You also hereby agree to receive the latest information about products, news and current events, rewards, promotions, special privileges, and initiatives from the Karangkraf Group, its partners, and advertisers.

7. Cancellation Charges and Refunds

The subscription fee paid is for the full term of your subscription. No refunds, cancellations, changes to subscription packages, or early termination of Sinar Harian ePaper are allowed.

For automatic renewals, no refunds or cancellations are allowed after the card has been charged.

To deactivate automatic renewal, please go to your Sinar Harian Newsstore account and deactivate automatic renewal. Your subscription will not be automatically renewed after the current subscription period expires.
